HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CONTEMPT APPLICATION (CIVIL) No. - 2911 of 2025 Court No. - 29 HON'BLE SYED QAMAR HASAN RIZVI, J.
1. Heard Shri Ajay Kumar Pandey, learned counsel for contempt petitioner-applicant and perused the material available on record. 2. The present contempt application has been filed with the following prayer:-
"to initiate the contempt proceedings against the contemnor/opposite party directing him to appear in person before this Hon'ble Court and punish them for deliberately and willfully disobeying and flouting the judgement and order dated 07.02.2025 passed by this Court in Petition No. 571 (A-227) of 2025 (Smt. Manjoo Vs. Tehsildar Milkipur, Tehsil Milkipur, Ayodhya and others)." 3.The contention of learned counsel for contempt petitioner-applicant is that despite the order passed by this Court on 07.02.2025 in Matters Under Article 227 No. 571 of 2025 by means of which a direction was issued to respondent no. 1 to consider and finally decide the pending proceedings of Case No.7689 of 2021 (Computerized Case No. T202104230407689) filed under Section 34 of the U.P. Revenue Code, 2006 as expeditiously as possible after affording full opportunity of hearing to the parties but without granting any unnecessary adjournment to either of the parties. 4. From perusal of order sheets annexed as Annexure No. 3 to the contempt petition, it is apparent that on most of the dates, the lawyers abstained from judicial work and on few dates, the Presiding Officer of Versus Counsel for Applicant(s) : Ajay Kumar Pandey Counsel for Opposite Party(s) :
Smt. Manjoo .....Applicant(s) Sri Ranjan Verma, Tehsildar, Tehsil Milkipur Distt. Ayodhya .....Opposite Party(s)
the court concerned was busy with administrative work. 5. The order sheet further indicates that on 25.08.2025 was the date fixed for hearing and thereafter the case was again fixed for 01.09.2025 for hearing. 6. The facts narrated in the contempt petition as well as order sheet as annexed therewith do not indicate any willful disobedience of the directions issued by this Court vide order dated 07.02.2025; on the part of the respondents and as such, no case of contempt is made out. 7. Looking into the factual matrix of the case and the nature of the order passed by the Court in Matters Under Article 227 No. 571 of 2025, this Court is of the view that it is not a fit case to entertain the instant contempt petition.
The instant contempt petition is accordingly, dismissed. 8. Needless to say that Section 34 of the U.P. Revenue Code, 2006 itself provides a period of 90 days for disposal of mutation proceedings and further in the teeth of order dated 07.02.2025 passed by this Court, it is incumbent upon the court concerned to expeditiously decide pending proceedings of Case No.7689 of 2021 (Computerized Case No. T202104230407689) at the earliest without any further delay.
