Taking note of the facts stated in the affidavit filed in support the application (C.M. application No. 2 of 2025) seeking condonation of delay as also that there is no opposition by the learned AGA to the same, the same is allowed. 2. Delay in filing the instant revision is hereby condoned. 3. Heard learned Counsel for the revisionist and learned A.G.A. for State-respondent. 4. By means of the present revision, the revisionist has impeached the order dated 22.04.2025 passed by Principal Judge, Family Court, Raebareli (in short "Family Court') in Criminal Case no. 350/2024 (Smt. Shailendra Rawat Vs. Ranjeet Singh). 5. Vide order under challenge, the Family Court provided interim maintenance of Rs.12,000/- per month from the date of filing of the application under Section 125 Cr.P.C. i.e. 09.10.2024. 6. Relevant portion of the impugned order reads as under :- "प्रािथनी के द्वारा माननीय उच्चतम न्यायालय की िविध व्यवस्था 2021 (2) SCC 324 रजनेश बनाम नेहा वाद में िदए गए िनदेर्शों के अनुपालन में िनधार्िरत प्रारूप पर अपना हैिसयत सूचना शपथपत्र दािखल कर िदया गया है। प्रािथनी के द्वारा अपने हैिसयत सूचना शपथपत्र 5 ख में अपनी शैक्षिणक योग्यता परास्नातक व अपना व्यवसाय गृिहणी दशार्या गया है तथा िवपक्षी को उत्तर प्रदेश पुिलस में आरक्षी होने से प्रितमाह रूपये 52,000/- की आय होने का अंकन िकया गया है। िवपक्षी की तरफ से प्रािथनी के िकसी आय के स्रोत को स्पष्ट करने के िलए कोई िवश्वसनीय अिभलेख पत्रावली पर दािखल नहीं िकया गया है, अतएव इस स्तर पर यही माना जाएगा िक प्रािथनी के पास आय का कोई स्रोत नहीं है, जबिक स्वीकृ त रूप से िवपक्षी उत्तर प्रदेश पुिलस में आरक्षी के पद पर कायर्रत है। पत्रावली में िवपक्षी का वेतन प्रमाणपत्र संलग्न है, िजसके अनुसार िवपक्षी की सकल आय रूपये 53513/- रूपये व कटौती के उपरान्त आय रूपये 52,752/-रूपये प्रितमाह है।" 7. The observations, quoted above, regarding the income of the revisionist who is discharging his duties of the post of Constable in U.P. Civil Police that he is earning after deduction Rs.52,752/- per month has not been impeached. The amount awarded i.e. 12,000/- per month is less than 25% of the net income of revisionist/husband. 8. Hon'ble Apex Court in Kulbhushan Kumar Vs. Raj Kumari, (1970) 3 SCC 129 Versus Counsel for Revisionist(s) : Indra Pal, Mohd. Shameem Khan Counsel for Opposite Party(s) : G.A. Ranjeet Singh .....Revisionist(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And Another .....Opposite Party(s) has held that 25% of the husband's net income would be just and proper to be awarded as maintenance allowance to the wife. 9. In view of the aforesaid, the instant revision has no force and therefore the same is dismissed. No order as to costs. 10. The copy of the order be sent to the Family Court forthwith.
