HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 5576 of 2025 Court No. - 7 HON'BLE JASPREET SINGH, J. Heard learned counsel for the petitioner. Notice on behalf of respondent no.1 has been accepted by the office of Chief Standing counsel. The petition has been preferred by the petitioner seeking expeditious disposal of the suit bearing Civil Case no.228 of 2022. The record indicates that the petitioner earlier had preferred a similar petition seeking same relief in the petition bearing Matter Article 227 No.1195 of 2024 which was dismissed by the Court on 11.03.2024. The petitioner had yet again filed another petition with the same prayer and it has been urged that in the civil court, the dates are not being fixed and the defendant is being harassed. Having considered the aforesaid request as well as from the perusal of the material on record, this Court does not find that there is any change in the circumstances which may permit the petitioner to file a second petition with same relief. Since, the first petition was dismissed for the same relief, this Court is of the clear view that the second petition for the same relief cannot be entertained. Accordingly, the petition is dismissed. September 17, 2025 Harshita Versus Counsel for Petitioner(s) : Surya Prakash, Chandra Prakash Counsel for Respondent(s) : C.S.C. (Jaspreet Singh,J.)
