HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1283 of 2025 Court No. - 12 HON'BLE KARUNESH SINGH PAWAR, J. The present anticipatory bail application has been filed seeking anticipatory bail in Case Crime No. 28/2025, Under Section-108, 61(2), 308(5), 318(4), 338, 336(3), 340(2) B.N.S and 66 D I.T Act, Police Station: Fatanpur. District Pratapgarh. Heard learned counsel for the applicant and learned A.G.A. for the State. Notice to respondent no. 2 is dispensed with in view of the proposed order. In the prosecution case, it is alleged that the applicant, along with the co- accused, blackmailed the informant?s brother by impersonating officers of the Crime Branch on the pretext of having found him watching pornographic videos. It is further alleged that substantial amounts of money were repeatedly demanded from him, and being unable to endure such persistent harassment, he ultimately committed suicide. While the co-accused were apprehended at the spot, the present applicant absconded.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He has no previous criminal antecedents, and there is no material on record so as to attract Section 108 BNS against him. Per contra, learned A.G.A. has opposed the bail application and submits that the bail application of Ankit alias Anurag Chauhan has been rejected by this Versus Counsel for Applicant(s) : Dharm Trivedi Counsel for Opposite Party(s) : G.A. Satpal Singh .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. And Another .....Opposite Party(s)
court vide order dated 16.9.2025. It is submitted that the co-accused Anoop Kumar has also named the applicant. It is not a case of false implication. Custodial interrogation is required to unearth the truth.
Learned counsel for the applicant submits that his case is distinct from the case of the co-accused Ankit.
Upon due consideration to the rejection order dated 16.9.2025 in the case of Ankit, nature and gravity of the offence and complicity of the applicant, it cannot be said that it is a case of false implication or the proceedings are intended merely to damage his reputation, and custodial interrogation is required.. Accordingly, no case for grant of anticipatory bail is made out. The application is, therefore, dismissed. September 17, 2025 kkb/ NABAIL No. 1283 of 2025 2 (Karunesh Singh Pawar,J.)
