HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1270 of 2025 Court No. - 12 HON'BLE KARUNESH SINGH PAWAR, J. The present anticipatory bail application has been filed seeking anticipatory bail in Case Crime No. 28/2025, Under Section-108, 61(2), 308(5), 318(4), 338, 336(3), 340(2) B.N.S and 66 D I.T Act, Police Station: Fatanpur. District Pratapgarh. Heard learned counsel for the applicant and learned A.G.A. for the State. Notice to respondent no. 2 is dispensed with in view of the proposed order. In the prosecution case, it is alleged that the applicant, along with the co- accused, blackmailed the informant’s brother by impersonating officers of the Crime Branch on the pretext of having found him watching pornographic videos. It is further alleged that substantial amounts of money were repeatedly demanded from him, and being unable to endure such persistent harassment, he ultimately committed suicide. While the co-accused were apprehended at the spot, the present applicant absconded. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He has no previous criminal antecedents, and there is no material on record so as to attract Section 108 BNS against him. Per contra, learned A.G.A. has opposed the bail application, contending that co-accused Anoop Kumar has specifically named the present applicant in his Versus Counsel for Applicant(s) : Dharm Trivedi Counsel for Opposite Party(s) : G.A. Ankit @ Anurag Chauhan .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. And Another .....Opposite Party(s) statement. It is alleged that the mobile phone used for receiving the extorted money is currently being operated by the applicant, and the distribution of money among the accused persons was carried out from his device. It is further submitted that custodial interrogation of the applicant is necessary to unearth the truth. It is not the case of false implication. Considering the heinous nature of the offence, no ground for anticipatory bail is made out. Upon due consideration of the role attributed to the applicant, his cooperation in the investigation, and the statement of the co-accused, as well as keeping in view the gravity of the offence, this Court is of the view that it cannot be said that the applicant has been falsely implicated or the proceedings are intended merely to damage his reputation. Accordingly, no case for grant of anticipatory bail is made out. The application is, therefore, dismissed. September 16, 2025 R.C. NABAIL No. 1270 of 2025 2 (Karunesh Singh Pawar,J.)
