HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 8704 of 2025 Court No. - 13 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri Rajat Pratap Singh, learned counsel for the applicant, Sri Manish Kumar Pandey, learned Additional Government Advocate for the State and perused the records. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 379 of 2025, under Sections 3 and 7 of Essential Commodities Act and Section 316(5) of B.N.S., registered at Police Station Tambaur, District Sitapur. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 14.08.2025 stating that upon inspection of the applicant's plywood factory technical grade urea and other articles used for preparation of glue made in manufacture of ply was recovered. However, the F.I.R. further states that an e-rickshaw carrying agricultural grade urea was seen entering the applicant's factory regarding which the applicant gave an application that some sacks containing rice were delivered by the e- rickshaw. The F.I.R. states that this statement appears to be suspicious. 4. In the affidavit filed in support of bail application it has been stated that the applicant is innocent, he has been falsely implicated in the present case and he has no criminal history. 5. The learned Additional Government Advocate appearing on behalf of the State has opposed the prayer for bail and he has submitted that the investigation of the case is still pending. The co-accused Manne Lal against who the allegation was of supplying the urea has been granted bail by this court by an order passed today in Criminal Misc. Bail Application No.8693 Versus Counsel for Applicant(s) : Rajat Pratap Singh, Digvijay Singh Counsel for Opposite Party(s) : G.A. Aslam @ Mohd. Aslam .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s)
of 2025. 6.
Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the F.I.R. itself states that upon inspection only technical grade urea was found from the applicant's factory and agricultural urea was not found therefrom and the applicant has been implicated solely on the basis of suspicion; that the applicant has no previous criminal history and he is languishing in jail since 21.08.2025 whereas another co-accused person has already been granted bail and without making any observation, which may affect the merits of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime. 7. Accordingly, this bail application stands allowed. 8. Let the applicant-Aslam @ Mohd. Aslam be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial court, unless his appearance is exempted by the learned trial court.
