Heard the learned counsel for the petitioner, learned Standing Counsel, who appears on behalf of the State-respondent nos.1 & 4 and Ms. Aprajita Bansal, who appears on behalf of the Opposite party nos.2 and 3, MVVNL. 2. This petition has been filed by the petitioner for the following main prayers:- "Issue a writ order or direction in the nature of certiorari thereby quashing of the impugned recovery citation dated 20.07.2024 issued by the opposite party no.4 (contained as Annexure No.1 to the writ petition), in the interest of justice. ii. Issue a writ order or direction in the nature of mandamus thereby commanding and directing to the opposite parties not to take any coercive action against the petitioner in pursuance to impugned recovery citation dated 20.07.2024 issued by the opposite party no.4." 3. Ms. Aprajita Bansal, on the basis of telephonic instructions, says that the Provisional Assessment Order was served on the petitioner. The Final Assessment Order was not served on the petitioner and the Recovery Certificate has been issued. 4. This writ petition is disposed of setting aside the Recovery Certificate and also the Recovery Citation dated 20.07.2024 with a direction to the petitioner to file his objections to the Provisional Assessment Order within a Versus Counsel for Petitioner(s) : O.P. Tiwari, Aman Pandey, Jainendra Singh Counsel for Respondent(s) : C.S.C., Aprajita Bansal Shokat Ali .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Energy Deptt. Lko And 3 Others .....Respondent(s) week from today. If such objections are filed, the same shall be considered by the appropriate Authority and Final Assessment Order shall be passed only thereafter.
