According to petitioner, he was engaged as watchman on daily wages in Bazpur Cooperative Sugar Factory Limited, Bazpur, District Udham Singh Nagar in the year 1986; he is serving continuously in the said capacity; however, the rightful benefits, admissible to him have not been granted. It is submitted that petitioner’s claim for regular status is also not being considered. 3. By means of this writ petition, petitioner has sought the following reliefs: “i. Issue a writ, order, or direction in the nature of mandamus commanding and directing the respondents to provide regular work to the petitioner during the forthcoming off-season after the closure of the cane-crushing season 2025-26, in the same manner as was done in previous off- seasons, until the fitment proceedings are completed and petitioner is adjusted against one of the available permanent vacancies. ii. Issue a writ, order, or direction in the nature of mandamus directing the respondents to treat the petitioner as continuously in service after the closure of the cane- crushing season 2024-25, to maintain his seniority, and further restraining the respondents from breaking his service in any manner until the petitioner is formally declared a permanent Watchman.” 4. Mr. T.A. Khan, learned Senior Counsel 2025:UHC:11249 appearing for Sugar Mills submits that petitioner has been given seasonal status. He submits that regular status could not be given because of ban imposed by the State Government. 5. Be that as it may, since petitioner has served for nearly four decades, therefore the right to be considered for regular status, cannot be denied to him. 6. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation, highlighting his grievances. 7. In the representation, it shall be open to the petitioner to stake claim for regular status. If such representation is made within ten days from today, decision thereupon shall be taken by the competent authority, as per law, within four weeks thereafter.
