This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences registered under Sections 303(2), 317(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, Section 4/21 of MMRD Act, Rule 4/54 of JMMC Rules and Rule 7, 9, 13 of JMPIMTS Rules pending in the court of Judicial Magistrate 1st Class, Dhanbad in connection with Madhuban PS Case No. 08 of 2025.
3. The petitioners are involved in illegal mining and transportation of coal. The tractor of the petitioner no.1 was apprehended which was loaded with 10 quintal of coal which was obtained illegally.
4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail and submits that the petitioners are not cooperating with the investigation.
5. Considering the nature of allegation since the petitioners are involved in illegal mining, transportation and storage of coal and further as per the submission of learned APP that the petitioners are not cooperating in the investigation, this Court finds it not a fit case for grant of anticipatory bail to the petitioners.
6. Accordingly, this Anticipatory Bail Application stands dismissed.
