Learned Counsel Mr. R. Nath is present for the respondent. The petitioner has preferred this appeal challenging the judgment and order dated 20.03.2025 delivered by Learned Special Judge(NDPS), Sepahijala District, Bishalgarh in connection with case No. Special (NDPS) 12 of 2024. Along with the memo of appeal, another application under Section 378(4) of Cr.P.C. is filed for granting special leave to appeal. No objection is raised by the respondent against the application for granting special leave to appeal. Learned Counsel for the respondent fairly submitted that at this stage, the accused is not willing to submit any objection and also submitted that the appeal may be admitted for hearing. We have also perused the judgment dated 20.03.2025 delivered by delivered by Learned Special Judge(NDPS), Sepahijala District, Bishalgarh in connection with case No. Special (NDPS) 12 of 2024 and on perusal of the judgment, being prima facie it appears that there are materials for proceeding in this case.
