HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 10509 of 2025 Court No. - 4 HON'BLE ABDUL MOIN, J.
1. Heard. 2. Under challenge is the order dated 23.06.2025, a copy of which is Annexure-1 to the petition, whereby the claim of the petitioner for being continued till the end of the academic session 2025-26 i.e. up to 31.03.2026 has been rejected. 3. Contention of the learned counsel for the petitioner is that despite the petitioner having attained the age of the superannuation on 31.03.2025 yet considering the government orders which are applicable, a person can continue till the end of the session i.e. 31st March of the subsequent year. 4. Upon the petitioner staking his claim for being continued till the end of the session i.e. 31.03.2026, the respondents vide the order impugned dated 23.06.2025 have rejected his claim after placing reliance on the Government Order dated 21.03.1984 read with Government Order dated 04.01.2017 on the ground that the petitioner has undergone Angioplasty and had earlier been transferred to Saifai but he had submitted an application for being transferred to Lucknow considering that he was suffering from High Blood Pressure, Sugar and being a heart patient, which was also acceded to by the respondents. 5. Subsequent thereto while working in the Sports College, Saifai, concerned Principal had also submitted an application dated 30.11.2022 for the purpose of transferring of the petitioner to Lucknow by indicating Versus Counsel for Petitioner(s) : Pramod Kumar Singh Counsel for Respondent(s) : C.S.C., Ashutosh Shahi Rameshwar Singh .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Deptt. Sports Govt. Lko. And 3 Others .....Respondent(s)
that he is not giving training properly to the students as he was suffering from heart disease and is also having difficulty with his eye sight. 6.
Contention is that once this Court vide judgment and order dated 29.05.2025 passed in Writ A No.6294 of 2025, a copy of which is Annexure-13 to the petition, had directed the respondents to decide the representation of the petitioner after according an opportunity to the petitioner consequently the respondents have considered his medical condition and having also not accorded any opportunity of hearing to the petitioner prior to passing the said order have violated the order of the writ court dated 29.05.2025 and have also considered such aspects of the matter which was not required to be considered and hence it is prayed that the impugned order be set aside. 7. On the other hand, learned counsel appearing for the respondents have supported the order impugned by contending that once the petitioner as per his medical condition is suffering from High Blood Pressure, Sugar and being a Heart patient and has also undergone Angioplasty and considering the complaint which has been submitted by the Principal of not according training to the students on account of said medical condition and the fact that the petitioner, in case extension is to be granted, would be serving as a Football Coach which requires good physical condition as such the respondents have not found feasible to grant extension to the petitioner till 31.03.2026. 8. Having heard learned counsel for the parties and perused the record, it emerges that earlier the petitioner was working as Football Coach. He has prayed for being given the session benefit i.e. for being continued till 31th March of the subsequent year although he has retired on 31.05.2025. Admittedly, grant of Session benefit is governed by the Governments
Order dated 31.03.1984 read with 04.01.2017. The respondents in the
order impugned after considering the aforesaid government orders and after considering the medical condition of the petitioner have not found the petitioner as physically fit for being continued as a Football Coach particularly when it requires a good physical condition and the petitioner on account of his Angioplasty, High Blood Pressure, Sugar has not been found to be in a good medical condition so as to be continued till WRIA No. 10509 of 2025 2
31.03.2026.
9. Once the respondents have considered the medical condition of the petitioner and as per the objective consideration after considering the government orders as applicable have found the petitioner, a Football Coach, not being entitled for the session benefit and particularly considering that it is the students who are to be trained in football which is a vigorous physical sport as such this Court does not find any reason to interfere with the order impugned.
