In the said affidavit, the petitioner has categorically acknowledged receipt of the entire amount legally due to him, which has been paid by respondent No.3 through cheques. The affidavit specifically refers to the cheque numbers and the amounts disbursed. In light of the above development and upon perusal of the affidavit submitted by the petitioner while accepting the payment, this Court is of the considered view that the cause of action no longer survives, and the writ petition has been rendered infructuous. 3.
