Heard Sri Rajesh Kumar Shukla, learned counsel for the petitioner, learned Additional Chief Standing Counsel for Respondents No. 1 to 3 and Sri Dilip Kumar Pandey, learned counsel for Respondent No.4. 2. Learned counsel appearing for the petitioner, after arguing at some length, has submitted that the petitioner had already filed an application for recall of order dated 15.01.2024 passed by the Tehsildar Sandila, Distrcit Hardoi in Case No.02438 of 2020 (Computerised No.T- 202010330402438), under Section 67 of the U.P. Revenue Code, 2006, Gram Sabha Kanipur vs Rahim; and the said application is pending, therefore, this Court may issue a direction to Respondent No.3 to consider and decide the application for recall of ex-parte order dated 15.01.2024. 3. Learned Standing Counsel appearing for the State-respondents does not have any objection if a direction is issued by this Court commanding the Respondent No.3 to consider and decide the petitioner's application for recall of order dated 15.01.2024. 4. I have considered the submissions made by the learned counsels for the parties, and I find that the petitioner has already filed an application for recall of the order dated 15.01.2024 on the ground that it is an ex-parte order and the said application is pending before Respondent No. 3, therefore, without entering into merits of the case, this petition is finally disposed of with a direction to Respondent No.3 to consider and decide the petitioner's application for recall of order dated 15.01.2024, filed Versus Counsel for Petitioner(s) : Rajesh Kumar Shukla, Umesh Dixit Counsel for Respondent(s) : C.S.C., Dilip Kumar Pandey Rahim .....Petitioner(s) State Of U.P. Thru. Collector, Hardoi And Others .....Respondent(s) in Case No.02438 of 2020, within a period of six weeks from today. 5. It is further provided that till disposal of the application for recall of order dated 15.01.2024, the demolition proceedings, in pursuance to the impugned order dated 15.01.2024, shall remain in abeyance.
