The present petition has been filed by the petitioner challenging the order dated 22.08.2025 whereby, the interim relief application filed in Appeal No.1476 of 2025 for staying order dated 03.07.2025 by which the fair price shop license was cancelled, was rejected. 3. In the order dated 03.07.2025, it was mentioned that 16 persons have given an affidavit against the petitioner. Based upon which, the order of cancellation was passed. 4. It is argued by the Counsel for the petitioner that the petitioner preferred an appeal against the said order. Along with the appeal, the affidavits of 16 persons were also annexed, who had stated that they have not given any statement against the petitioner. In view of the said, the appellate court ought to have granted the interim relief but the same has been denied. 5. Considering the fact that the order is based upon the statement of 16 persons, who have resile from their statement, the present petition is disposed off directing the appellate authority to decide the Appeal No.1476 of 2025 in accordance with law with all expedition preferably within a period of three months from the date of production of a certified copy of this order.
