Heard learned counsel for petitioner and learned State Counsel for opposite parties. 2. Petition has been filed seeking following prayer:- (i) issue a writ, order or direction in the nature of mandamus commanding/ directing the opposite parties to allow the petitioner and his school going children to reside in the official accommodation bearing Awas No.59 E, Sthit Koyalabagh Colony, Hardoi, till completion of their study/examination of academic year 2025-26 i.e Class-XII & Class-X, for which the petitioner is ready to pay the admissible rent in cash. 3. Since petitioner's grievance would require consideration of factual aspects in discretion of the authority concerned, liberty is granted to petitioner to make a fresh representation within three days before opposite party no.2 i.e. District Magistrate, Hardoi. In case such a representation is filed, the same is required to be decided within a period of ten days from the date a certified copy of this order is produced before the said authority. 4. It has been submitted that in the meantime the accommodation in question has been locked by the opposite parties in view thereof it is directed that till decision on petitioner's representation, the petitioner shall be permitted to enter in the official accommodation forthwith and shall not be required to vacate the premises in question. 5.
