SANAGA ASHOK KUMAR The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus directing for fresh or de novo or reinvestigation in connection with Crime No. 295/2014 registered at Nagarampalem Police Station, Guntur and consequently direct the investigation to be transferred to any other Competent Investigating Agency under the supervision and control of Respondent No.4, or direct the Respondent No.2 to act progressively and take necessary steps pursuant above said crime and also direct for compensation to the Petitioner.” 2. Sri Nuthalapati Mohan, learned counsel for the Petitioner would submit that the Petitioner is seeking de novo investigation in Crime No.295 of 2014 on the file of Nagarampalem Police Station, Guntur. Learned counsel would further submit that, Police referred the said case as ‘false’. Thereafter, the Petitioner filed a private complaint which was referred to the Police and the Police registered the case and referred it as ‘false’. As such, the Petitioner 3 filed a protest petition before the Court of Special Mobile Magistrate, Guntur and the same is pending consideration. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, would submit that the petition may be disposed of since the relief sought has become infructuous. 4. Considering the submissions made, the Writ Petition is disposed of directing the concerned Magistrate to take a decision over the protest petition in C.F.R.No.102 of 2014, which is pending consideration, as expeditiously as possible, without granting any further adjournments in a casual way by mere asking, since the matter is of the year 2014. There shall be no order as to costs.
