1. This is the first bail application filed under Section 483 of the B.N.S.S. for grant of regular bail to the applicants who have been arrested in connection with Crime No. 432/2024 registered at Police Station Dharsiva, District- Raipur (C.G.), for the offence punishable under Sections 104(1), 103(3), 283, 61 & 3(5) of BNS, 2023. 2
2. As per the prosecution story, present applicant along with other co- accused persons have abducted the Lukesh Patel (deceased) and thereafter killed him. Based upon report, aforementioned crime/offence has been registered against the applicant. 3. Learned counsel for the applicant contended that the applicant is innocent and has been falsely implicated in this case, he has not committed any offence as alleged against him. There is no specific evidence/ material available to connect this applicant in the alleged offence/crime. As per opinion of the doctor, deceased died due to cardiac arrest and not by the assault made by the applicant. There is no any other criminal antecedents against the applicant. He is in jail since
29.07.2024. conclusion of trial may take some time, hence, applicants may be released on bail. 4. Per contra, learned State counsel opposes the bail application and submits that serious allegations have been levelled against the applicants, hence, they are not entitled for grant of regular bail. 5. I have heard learned counsel for the parties and perused the record with utmost circumspection. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case, submission of the counsels, statements of the prosecution witnesses, further considering that based on the memorandum statement of the applicant knife was recovered in which blood stains was found, I am not inclined to allow this bail application.
Accordingly, the bail application of applicant- Bhupendra @ Roshan Verma involved in Crime No. 432/2024 under Sections 140(1), 103(3), 283, 61 &
3 3(5) of BNS, 2023 at Police Station Dharsiva, District- Raipur (C.G.), is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
