Counsel for Applicant :- Arvind Kumar Verma,Punit Kumar Shukla,Vaishnavi Gupta Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. 1.Heard learned counsel for the applicant, learned Additional Government Advocate for the State and perused the record. 2.It is alleged in the prosecution case that the applicant fired several shots at him from his firearm with an intent to kill, however, he was saved but the bullet injury came on his son Ayush in his right leg who fell unconsious. Ritesh Singh and Anuj Singh have also allegedly received grievous injuries. 3.Learned counsel for the applicant submits that the applicant fired shots at Nagendra, however, the applicant, as per statement of the injured, never intended to cause injury to Ayush and accidentally, bullet hit him. The injury received by Ayush is on upper thigh side, i.e. on non-vital part. Role of causing injury to other twp persons, namely Ritesh and Anuj is not on the present applicant. The applicant has explained criminal history in the bail application and in the rejoinder affidavit. The applicant is in jail since 25.7.2024. It is further submitted that there is no possibility of the applicant of fleeing away after being released on bail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. 4.Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for
the applicant. 5.Considering the facts and circumstances of the case, the fact that the applicant has explained criminal history, injuries are on non-vital part, the incident appears to have occurred due to sudden and grave provocation, arguments advanced by learned counsel for the parties, the period for which the applicant is in jail and without expressing any opinion on the merit of the case, I find it to be a fit case for enlarging the applicant on bail.
