This petition has been filed with the following prayers :- Issue a writ, order or direction in the nature of mandamus commanding the opposite parties specially opposite party no.4 to conduct an enquiry against the opposite party no.6 and his associates regarding misappropriation of government funds of Gram Panchayat Rikhapur, Tehsil and Block Lambhua, District Sultanpur (as contained in Annexure No.2), in the interest of justice. i. Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to initiate the recovery proceedings against the opposite party no.6 for misappropriation of MGNREGA funds for the work of period 01 July 2020 to 01 January 2025 of aforesaid Gran Panchayat Rikhapur, Tehsil and Block Lambhua, District Sultanpur, in the interest of justice. ii. Learned Standing Counsel has produced before this Court instructions dated 06.9.2025 sent by the District Panchayat Raj Officer Sultanpur wherein it has been stated that the application of the petitioner submitted under the 1997 Inquiry Rules has been entertained and the proceedings having been initiated a committee has been appointed by the District level officer to conduct an inquiry, after a report is received necessary orders shall be passed. Insofar as the second prayer of the writ petitioner is considered relating to inquiry by the ombudsman into irregularities committed by the Gram Pradhan under the MGNREGA scheme, and the ombudsman is seized with the matter. Application of the petitioner copy of which has been filed as Annexure no.5 to the petition seems to be pending with the Lokpal MGNREGA . The instructions are kept on record. This petition is disposed of with the direction to the Lokpal MGNREGA opposite party no.5 to consider and decide the application of the petitioner in Versus Counsel for Petitioner(s) : Vivekanand Misra, Ravindra Kumar Dwivedi Counsel for Respondent(s) : C.S.C., Mohan Singh Suraj Singh .....Petitioner(s) State Of U.P.
