Mr. Jitendra Chaudhary, learned counsel for the petitioner. 2. Mr. Ganesh Kandpal, learned Deputy Advocate General for the State of Uttarakhand. 3. Petitioner request for re- engagement as Junior Engineer on daily wages in MGNREGA has been rejected by District Magistrate, Udham Singh Nagar, vide order dated 26.12.2023. Feeling aggrieved by the said order, petitioner has approached this Court. 4. The reason assigned for rejecting petitioner’s request is that an FIR was registered against him and recovery of financial loss, suffered by public exchequer, was also ordered from him after finding him guilty. 5. Learned counsel for the petitioner submits that other similarly situate employees, from whom also recovery was made after they were found guilty, were retained in service and petitioner was given stop motherly treatment. 6. Learned State Counsel submits that Junior Engineer in MGNREGA holds a key position, as entire amount for different works is disbursed through Junior Engineer. He, thus, submits that District Magistrate was justified in refusing to accede to the request for re-engagement of petitioner as Junior Engineer. 2025:UHC:10190 7. If other similarly situate persons were re-engaged in MGNREGA, then petitioner is entitled to similar treatment. 8. The writ petition is, accordingly, disposed of with liberty to petitioner to approach District Magistrate, Udham Singh Nagar by making a representation. If he makes representation within one week from today, decision thereupon shall be taken, as per law, within three months thereafter, untrammelled by any observation made in the impugned order dated 26.12.2023.
