This anticipatory bail application under Sections 438 and 440 of the Code of Criminal Procedure has been preferred by the petitioner apprehending his arrest for offences registered under Sections 366(A) of the Indian Penal Code. 4. As per the allegations made in the FIR, the petitioner has kidnapped the daughter of the informant who according to the informant is of 17 years. 5. Learned counsel for the petitioner submits that daughter of the informant is aged more than 20 years now and this petitioner has solemnized the marriage with the daughter of the informant in Gujarat. He produces the marriage registration certificate issued bearing registration no. 16 of 2023 under the Gujarat Registration of Marriage Act, 2006. He submits that at the time of marriage, the girl was more than 18 years and verifying the age, 2025:JHHC:11580 2 the marriage was registered by the registering authority. 6. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 7. Considering Annexure No. 2 which is the Marriage Registration Certificate dated 06.05.2023, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M. Palamau, in connection with Rehla P.S. Case No.34 of 2023, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
