(2) Petitioner has been serving as Junior Assistant-cum-Data Entry Operator in different Nagar Panchayats in District Haridwar since March, 2018. Presently, he is serving in Nagar Panchayat, Imelikheda, Haridwar since 29.3.2022. In this writ petition, petitioner has sought the following reliefs: “i) Issue a writ, order or direction in the nature of mandamus commanding the respondent nos. 1 to 3 to pay the petitioner ‘minimum of pay scale’ of Rs. 5200-Rs. 20200 with grade pay of Rs. 2000 (21,700-69100 Level-3) as being paid to the regular em ployee working on the post of ‘Junior Assistant cum Data Entry Operator’. ii) Issue a writ, order or direction in the nature of mandamus commanding the respondent nos. 1 to 3 to consider and regularise the services of the petitioner on the post of ‘Junior Assistant cum Data Entry Operator’. iii) Issue a writ, order or direction in the nature of mandamus commanding the respondent nos. 1 to 3 to grant the petitioner all consequential benefits.” (3) Learned Counsel for the petitioner refers to representation made by the petitioner, which is enclosed as Annexure- 11 to the writ petition. In that representation, petitioner has requested to regularise his services on the post of Junior Assistant-cum-Data Entry Operator and also to pay him m inimum of pay scale. (4) Since petitioner has approached the competent authority by making a representation, therefore, this Court thinks that ends of justice would be met if the competent authority is directed to consider petitioner’s claim for grant of minimum of pay scale and regularisation. (5) Accordingly, writ petition is disposed of with a direction to Executive Officer, Nagar Panchayat, Imelikheda, Haridwar to take decision on petitioner’s representation, as per law, within ten weeks from the date of presentation of certified copy of this order. (6) Till decision is taken on petitioner’s representation, he shall not be disturbed.
