THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE MOHAMMAD NAWAZ
ORAL ORDER
Petitioner/accused No.3 has preferred this petition praying to enlarge him on bail.
2. Heard the learned counsel for petitioner, the learned Additional SPP for the State and perused the materials on record.
3. Charge sheet is filed against accused Nos. 1 to 4 for offences punishable under Sections 397 and 506(b) of IPC.
4. Materials on record would go to show that petitioner, arraigned as accused No.3, was initially granted bail on 10.08.2018. Trial was held in S.C.No.1849/2018 on the file of 67th Additional City Civil and Sessions Judge, Bengaluru city. At the fag end of trial, petitioner absconded and failed to appear before the trial Court and therefore, NBW was issued against him. He voluntarily

surrendered before the Court on 08.01.2025 and he was remanded to Judicial Custody.
5. Case against the petitioner has been split up and it is numbered as S.C.No.871/2024, because of his abscondance. The material on record reveal that even after issuance of NBW, petitioner remained absent and therefore, separate split up case was registered against him.
6. The learned Additional SPP has contended that when the trial was at the fag end petitioner absconded and therefore, if he is released on bail, he may once again escape from the clutches of law. It is further contended by the learned Additional SPP that in S.C.No.1849/2018 accused therein are convicted.
7. Petitioner was once granted the relief of bail, but he has misused the liberty. Considering the facts and circumstances and considering that the trial is at fag end, petitioner is not entitled for bail.
