This petition has been filed with the following prayers :- "(i) issue a writ, order or direction in the nature of certiorari thereby quashing of the impugned recovery citation dated 04.09.2024 issued by the opposite party no.4 (contained as Annexure No.1 to the writ petition), in the interest of justice. (ii) Issue a writ, order or direction in the nature of mandamus thereby commanding and directing to the opposite parties not to take any coercive action against the petitioner in pursuance to impugned recovery citation dated 04.9.2024 issued by the opposite party no.4." We have heard learned counsel for the petitioner and Ms. Aprajita Bansal who appears on behalf of respondent no.2 and 3 and learned Standing Counsel who appears on behalf of respondent no.1and 4. Ms. Aprajita Bansal, on the basis of telephonic instructions says that the Provisional Assessment Order was served on the petitioner. The Final Assessment Order was not served on the petitioner and the Recovery Certificate has been issued. This writ petition is disposed of setting aside the Recovery Certificate and also the Recovery Certificate dated 04.9.2024 with a direction to the petitioner to file his objections to the Provisional Assessment Order within a week from today. If such objections are filed, the same shall be considered by the appropriate Authority and Final Assessment Order shall be passed only thereafter.
