JUSTICE LALITHA KANNEGANTI ORAL ORDER The present petition is filed by the petitioner/wife seeking transfer of M.C.No.7424/2024 filed by the respondent/husband pending on the file of the III Additional Principal Judge, Family Court, Bengaluru to the file of the Family Court at Shivamogga. 2. The parties are referred to as husband and wife for the sake of convenience. 3. The facts of the case are that the marriage between the petitioner and the respondent was solemnized on 28.02.2020. In the wedlock, they are blessed with a daughter. In view of the disputes between the parties, the husband had filed M.C.No.7424/2024 seeking dissolution of marriage on the file of the III Additional Principal Judge, Family Court, Bengaluru. 4. Learned counsel appearing for the wife submits that the wife is residing at Shivamogga along with her aged parents and the distance between Bengaluru and Shivamogga is about 310 kilometers and she has to take care of the daughter who is - 3 - NC: 2025:KHC:15419 CP No. 64 of 2025 aged about 1 year 2 months old. It is submitted that it is difficult for her to travel on the each date of hearing from Shivamogga to Bengaluru. Considering the inconvenience that is being caused to the wife, M.C.No.7424/2024 may be transferred from Bangalore to Shivamogga. 5. When this matter came up on 09.04.2025, learned counsel for the petitioner was present and there was no representation on behalf of the respondent. This matter was directed to be listed under the caption “part heard” today and today also, there is no representation on behalf of the respondent. It appears that the respondent is not interested to pursue the matter. Hence, this Court is disposing of the matter on the merits of it. 6. Having heard the learned counsel appearing for the petitioner/wife, perused the material on record. Considering the fact that the distance between Shivamogga and Bengaluru is about more than 310 kilometers and the wife has to take care of the girl child who is aged about 1 year 2 months old, this Court deems it appropriate to pass the following order: - 4 - NC: 2025:KHC:15419 CP No. 64 of 2025 ORDER i. M.C.No.7424/2024 filed by the respondent pending on the file of the III Additional Principal Judge, Family Court, Bengaluru, is withdrawn and the same is transferred to the file of the Family Court at Shivamogga. ii.
