“I am a resident of the said address and am a housewife and an old aged lady. Yesterday on dated 7-7- 2024 at about 6:15 in the evening, I went out for walk and when I reached near my house, I saw two unknown young persons on a motorcycle, but one of them came from behind and pulled out the gold earrings from my ear and I started raula and I also chased them, then a unknown young person sat on the motorcycle with another unknown young person and ran away from the spot. Weight of the earrings found as 2-1/2 grams, whose value now will be around Rs.15000/-. Legal action may kindly be taken against both of the accused persons.” 3. Counsel for the petitioner has chosen not to appear today. The bail petition pertains to the year 2025, further wait is not justified. Hence, this Court deems appropriate to proceed with the case on merits after nominating a Legal Aid Counsel. Accordingly Ms. Archi Maggo, Advocate, Enrollment No. PH/11519/2025, Mobile No. 7973468706, who is present in the Court is appointed as a Legal Aid Counsel to assist this Court on behalf of the petitioner. She has gone through the paper book supplied by the learned State Counsel and submits that there is delay in lodging of the FIR. Even though the incident occurred on 07.07.2024 at about 6: 50 pm, however, the FIR was registered on 08.07.2024. She submits that nothing has been recovered from the petitioner and he has been falsely implicated in the aforesaid case. The petitioner is in custody since 09.10.2024. The investigation in the case is already complete and nothing has to be recovered from him. (
