SC CUM SPL PP CID The Court made the following: ORDER: The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (in short, “Cr.P.C.”) has been filed by the Petitioner/ Accused No.3, seeking quashment of the proceedings pending against her in C.C.No.2267 of 2021 on the file of the Court of the II Additional Judicial Magistrate of I Class, Kakinada, East Godavari District. 2. Heard Sri Posani Venkateswarlu, learned Senior Counsel for the petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. Learned counsel for the petitioner would submit that the petition may be disposed of without causing any prejudice to the rights and contentions of the petitioners, by dispensing the presence of the petitioners before the Trial Court. 4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. 5. In that view, the Criminal petition is disposed of. However, the petitioner is at liberty to raise all the contentions before the Trial Court in her defence. The presence of the petitioner before the Trial Court is dispensed with unless their presence is specifically directed by the Trial Court.
