Heard learned counsel for the petitioner and Shri Umeshwar Pratap Pandey, learned counsel for respondent No.3. 2. The present petition has been filed by the petitioner alleging that despite an award passed in favour of the petitioner under the Payment of Wages Act, 1936, the amount is not being paid. 3. It transpires that earlier the respondent had approached this Court by arguing that the appeal was dismissed, however, they were ready to make the deposits, which are required to prefer the appeal. The said petition was disposed of on 09.01.2025 permitting the respondent to move a recall application along with the deposit. In terms of the said order, the deposit has been made and a recall application was filed in the appeal. It is stated that the appeal is fixed for hearing. 4. The present petition has been filed seeking withdrawal of the said amount deposited by the respondent. 5. Considering the fact that the appeal is still pending, the present petition is disposed of directing the appellate authority to decide the pending appeal without giving any unnecessary adjournment to any of the parties, within a period of four weeks from today. 6.
