learned counsel for the applicant.
2. Ms. Meenakshi Sharma, learned Brief Holder for the State.
3. Present applicant Raju, S/o Suresh Singh is praying for bail in reference to FIR dated 20.08.2025, bearing FIR No. 0321 of 2025, registered at P.S. Bajpur District U.S. Nagar wherein the present applicant along with one Vikas have been implicated for the offences punishable under Sections 109(1) and 3(5) of BNS
2023.

Learned counsel for the applicant submits that the applicant is innocent, though, he is named in the FIR but no specific role has been assigned to him in the FIR. As per the FIR, two persons called the victim on phone and then caused this crime. She further argued that the applicant has no previous criminal history and is languishing in jail since 21.08.2025, and now investigation has been completed and charge sheet has been filed, and, as such, there is no need of custodial interrogation of the applicant.
5. On the previous date, State counsel was directed to get instructions. Today, Ms. Meenakshi Sharma, learned Brief Holder, on instructions, apprise to this
Court that charge sheet has already been filed, however, she submits that the injuries are grievous in nature. She also apprise to this Court that applicant has no previous criminal history.
6. After hearing the arguments of the
learned counsel for the parties and taking into consideration that charge sheet has already been filed, and, as such, there is no need of custodial interrogation of the applicant, and, furthermore, the applicant has no previous criminal history, this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant Raju be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
