Order 07/05/2025
1. The present bail application has been filed by the accused- applicant under Section 483 of the B.N.S.S, 2023 against the
order dated 02.04.2025 passed by learned Special Judge Scheduled Caste and Scheduled Tribes Prevention of Atrocities Cases Sikar (Raj.) in connection with FIR No. 325/2024, registered at Police Station Sadar Sikar, District Sikar for the offences punishable under Sections 126(2), 115(2), 140(3), 308(2), 352, 351(2), 351(3) of BNS, 2023 and Sections 3(1)(r), 3(1)(S), 3(2) (va) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities), 1989 (Amendment Act, 2015) (for short 'SC/ST Act'), by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed.
2.
Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter.
[2025:RJ-JP:19257] (2 of 3) [CRLMB-5413/2025]
Learned counsel argues that the FIR has been lodged with a delay of 25 days. Learned counsel also argues that in the FIR, Ranjeet Singh, Ajaypal Singh, Naresh Kumar and Lokendra Singh have been named and all the named accused-persons have been enlarged on bail by the Co-Ordinate Benches of this Court.
Learned counsel contends that the accused-applicant was arrested on 01.04.2025 and since then, he is behind the bars. Learned counsel prays that the trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail.
3. On the other hand, learned Public Prosecutor opposes the bail application.
4. Heard learned counsel for the parties and also perused the material available on record.
5. Having regard to the facts and circumstances of the case; considering the facts that the accused-applicant has not been named in the FIR; that in the statement recorded under Section 180 of BNSS, the injured has not named the accused-applicant; that the named accused-persons 1. Ajaypal Singh has been enlarged on bail by Co-ordinate Bench of this Court in S.B. Criminal Appeal (SB) No.584/2025 vide order dated 06.03.2025;
2. Naresh Kumar has been enlarged on bail by Co-ordinate Bench of this Court in S.B. Criminal Appeal (SB) No.102/2025 vide order dated 21.01.2025; 3. Ranjeet Singh has been enlarged on bail by Co-ordinate Bench of this Court in S.B. Criminal Appeal (SB) No.3391/2024 vide order dated 20.12.2024 and 4. Lokendra Singh has been enlarged on bail by Co-Ordinate Bench of this Court in S.B. Criminal Appeal (SB) No.3195/2024 vide order dated
17.12.2024. Further, considering the fact that trial will take long
[2025:RJ-JP:19257] (3 of 3) [CRLMB-5413/2025] time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant.
6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Prameshwar S/o Shri Ramchandra, arrested in FIR No. 325/2024, registered at Police Station Sadar Sikar, District Sikar shall be released on bail; provided he furnishes personal bond in the sum of Rs.50,000/- and two solvent sureties of Rs.25,000/- each to the satisfaction of the learned trial Court.
7. The Accused-Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
