Petitioner has been made accused in connection with Sahibganj (Muffasil) P.S. Case No. 13/2024, corresponding to G.R. Case No.317/2024, S.T. No. 208 / 2024 for the offences registered under Sections 365/34 of the I.P.C., pending in the Court of learned Additional Sessions Judge-III, Sahibganj. Bail application of the petitioner was earlier rejected by this Court vide B.A. No.7263 of 2024 by order dated 21.11.2024. On 20.02.2024, son of the informant left his house. Thereafter, he was found missing. It appears that on the pointing out of the petitioner dead body of the deceased was recovered. Mr. Sabyasanchi, learned counsel for the petitioner submitted that during trial four witnesses have been examined and they have stated that the dead body of the deceased was recovered on the basis of joint confession of this petitioner and Dharmi Devi and Dharmi Devi has been granted bail by this Court. While granting bail to co-accused Dharmi Devi, this Court has observed that nothing was recovered on the basis of her confession and the fact that dead body was recovered on the basis of joint confession of this petitioner and Dharmi Devi was not available at that time and it has come in the statement of witnesses recorded during the trial. In view of the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, her prayer for bail stands rejected. (Ambuj Nath, J.) Jay/-
