Vivek Singh Thakur, Judge (Oral) This appeal has been filed by the appellant against the judgment and decree dated 27.05.2024 passed by learned Principal Judge, Family Court, Hamirpur, District Hamirpur, in HMA Petition No. 286 of 2021, titled as ‘Sapna Thakur versus Ravel Singh”, whereby her petition filed under Section 13(1)(ia)(ib) of the Hindu Marriage Act, 1955, for dissolution of marriage, has been dismissed. 2 Neutral Citation No. ( 2025:HHC:29667 ) 2. At the request of learned counsel for the parties, the matter was referred for mediation to learned Mediator Mr. S.C. Sharma, Senior Advocate. 3. Today (01.09.2025) during pre-lunch session, though the report of the learned Mediator was received with the report that dispute stood amicably settled, however, in the Court, learned counsel for the parties, under instructions, submitted that there is some misunderstanding with respect to certain clauses, especially clauses (ii) & (iv) of the compromise, and, therefore, a request was made to refer the matter again to the learned Mediator to re-write these conditions. Accordingly, matter was again referred to learned Mediator for clarification of the terms of the compromise arrived at between the parties. 4. Fresh report of the learned Mediator has been received whereby it has been informed that fresh compromise dated 01.09.2025 has been entered between the parties which has been signed by parties as also duly endorsed by learned counsel for the parties. 3 Neutral Citation No. ( 2025:HHC:29667 ) 5. The compromise entered between the parties reads as under: “1. That both the parties undertake to resume matrimonial relation and will live together peacefully as Husband & Wife fulfilling all the obligations. 2. That first party is at liberty to reside with her parents in order to serve them in the hour of need and she is to take care of her in laws also. 3. That both the children namely son Rajat Chandel aged 20 years & daughter Sonia Thakur aged 17 years will remain in the company of the parents i.e. both First Party & Second Party. 4. That the children will remain in the custody of both the parties. 5. That Second Party is residing at Shimla & after every three months he will visit his parental house to meet his family (wife & children). He further undertakes to pay Rs. 3500/- to his family on or before 15th of every month. 6. That in view of the present compromise the first party undertakes to withdraw all the cases pending before the Hon’ble High Court & any other Subordinate Court. 7. That both the parties would be duty bound to follow the aforesaid terms and conditions. That this compromise has been effected between the parties without any pressure and with their free will and the same has been read over and explained to them and after understanding the contents of the same vernacular, the parties to the above compromise has signed the same.” 6. Appeal is disposed of in terms of the aforesaid compromise and the terms of the compromise shall form part of the decree. 7. Before parting, we would like to record words of appreciation for learned Mediator Mr. S.C. Sharma, Senior Advocate for his earnest efforts for materializing settlement and also for learned counsel and parties whose active cooperation has resulted into happy ending of litigation.
