1. Heard Mr. Vipin Tiwari, learned counsel for the petitioners. Also heard Mr. Prafull N. Bharat, learned Advocate General along with Mr. Sangharsh Pandey, learned counsel, appearing for the State/respondent Nos. 1, 3, 4 & 5 and Mr. Shashank Thakur, learned Advocate, appearing for respondent Nos. 2 & 3 / High Court of Chhattisgarh & District sessions Judge, Durg. 2.
The present writ petition has been filed by the petitioners under Article 226 of the Constitution of India styled as ‘Public Interest Litigation’, seeking following reliefs :
“10.1 That, the Hon'ble Court may kindly be pleased to quash the order dated 10.09.2024 (Annexure P-1) passed by the respondent no. 6 being illegal and arbitrary, in the interest of justice. 10.2 That, the Hon'ble Court may kindly be pleased to issue the writ of mandamus commanding upon the respondents by directing them to start the construction work of advocates room no. 4 in the District Court Durg premises with immediate effect, in the interest of justice. 3 10.3 That, Any other order of orders or Direction or Relief though just and fit in the circumstances of the case may also kindly be granted.”

From perusal of the record, it transpires that the petitioners have not deposited the security amount as per the rules of High Court and the petitioners are Advocates and office bearers of the District Bar Association, Durg and the petitioners have no locus to challenge the impugned order dated 10.09.2024 (Annexure P/1) by which out of 09 sanctioned works, 08 works have been cancelled. 4. On a pointed query being made from learned counsel for the petitioners with respect to the locus of the petitioners for filing the present petition and whether the present petition be termed as Public Interest Litigation, he could not give satisfactory reply and prays for withdrawal of the instant petition. 5.
