The Court made the following Order: The learned Assistant Public Prosecutor appearing for the State submits that the Special Judge for Trial of Offences under the POCSO Act, 2012, Chittoor, had passed an order dated 17.01.2025 whereby the request of the prosecution to grant an adjournment for producing PW15 for deposing as a witness in POCSO SC.No.56 of 2021 was rejected by the learned Judge on the ground that PW15 was required to be produced on 17.01.2025 and inspite of conditional order, the prosecution had failed to produce PW15. On this 2 ground, the learned Magistrate had also held that the prosecution has been showing lethargic attitude in producing the witness. 2. The learned Assistant Public Prosecutor submits that the matter is now posted on 07.05.2025. It is submitted that the evidence of PW15 would be crucial as he would disclose the facts and he examined the witnesses, visited the scene of offence and arrested the accused, obtained the wound certificate and also other material relating to the scientific evidence such as collection of blood samples and DNA comparison and forwarded the same to the FSL. 3. Considering the nature of offence and also investigation done by PW15, this Criminal Petition is disposed of, setting aside the order dated 17.01.2025, granting one more opportunity to the prosecution to adduce the evidence of PW15, preferably on 07.05.2025 or any other day as directed by the Special Judge for Trial of Offences under the POCSO Act, 2012, Chittoor, in POCSO SC.No.56 of 2021. 4.
