This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 49/2025 registered at Police Station – Baikunthpur, District – Korea (C.G.) for the offence punishable under Sections 64, 331(2), 332(b), 351 of the Bharatiya Nyaya 2 Sanhita, 2023. 2. The prosecution story, in brief, is that the it has been alleged that the victim was in her rented house on dated 25.01.2025 and near about 8:00 pm the applicant knocked the dooe of victim’s rented house and then he pushed the door and entered victim’s house and then he has committed rape on victim be pressing her mount and threatening to kill her. On the said allegations the FIR was registered against the present applicant hence, he is also liable for action. Hence, this application. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is submitted that though the complainant has made allegation against the applicant for outraging her modesty, but the said incident had not taken place at any point of time. It is submitted that on account of previous enmity, one Sanjay Agrawal, who is a business man in real estate, has instigated the complainant, who is his tenant, to lodged the instant complaint against the applicant. Therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the applicant is not entitled for grant of anticipatory bail in this case. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and 3 gravity of allegation leveled against the applicant, and from the perusal of the case diary it transpires that the complainant is tenant of said Sanjay Agrawal, who is having enmity with the applicant herein, and there is no clear evidence on record to substantiate the incident of applicant herein outraging the modesty of the complainant/victim, at this stage without expressing any opinion on merits, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7. Accordingly, the anticipatory bail application of applicant- Ramkumar Ravi Alias Ramjee Singh Ravi is allowed. If the applicant surrenders himself before Additional Session Judge F.T.C., Baikunthpur, Korea (C.G.) within 20 days from today and furnishes a personal bond with a solvent surety in the like sum to the satisfaction of the said Court, he be released on bail.
