The second respondent lodged the First Information Report1 stating that the petitioner and the informant were in relationship and the petitioner by promising the marriage induced the complainant to have sexual intercourse and thereafter breached the promise to marry. 3. The petitioner and the complainant are present before this Court and have filed an application for compounding the offences stating that they have amicably resolved the dispute among themselves and in terms of the settlement, the second respondent has agreed to withdraw all the allegations 1 Hereinafter referred to as ‘FIR’``` - 3 - NC: 2025:KHC:12031 CRL.P No. 1895 of 2025 made against the petitioner and has no objection for quashing the impugned FIR. 4. The application is placed on record. 5. Although the offences alleged against the petitioner are cognizable and non-compoundable, given the fact that the second respondent has agreed to withdraw all the allegations and has no objection for quashing the impugned FIR, it would be futile to subject the petitioner for further investigation since the probability of the police filing the charge sheet is unlikely in the light of the settlement. In such circumstances, the continuation of the investigation would be an abuse of the process of law. 6. Accordingly, Criminal Petition is allowed.
