2. By this application, the petitioner has prayed for pre-arrest bail in connection with Jalukbari P.S. Case No. 301/2025 registered under Section 85/118(1)/74/351(2) of BNS, 2023.

The FIR dated 08.07.2025 lodged by the victim reveals that after her marriage with the petitioner, the petitioner tortured her mentally and physically and that due to the same, she had to leave her matrimonial house and was staying at her parents’ house. She further stated that on 07.07.2025, her husband dragged her on the road and assaulted her in different parts of her body.
4. Mr. B.B. Gogoi, learned counsel for the petitioner submits that the victim was allegedly in a relationship with some other person and as such, there was quarrel amongst them, which had led to the filing of the FIR.
5. Mr. D.P. Goswami, learned Add. Public Prosecutor for the State respondent submits on perusal of the Case Diary that the witnesses had stated that they heard about the incident and by showing the Medical Report, the learned Add. Public Prosecutor submitted that the injury upon the victim was simple in nature caused by blunt weapon.
6. It is also noticed that the petitioner was enlarged on interim pre-arrest bail vide Order dated 24.07.2025 with the condition that he may go before the Investigating Officer and give his statement.
7. It is seen from the Case Diary that the petitioner had gone before the Investigating Officer and got his statement recorded by him. As such, the petitioner is seen to have complied with the directions in the said interim order.
8. In view of the same, this Court deems it fit that the interim pre-arrest bail
order may be made absolute subject to the condition that the petitioner should
Page No.# 3/3 fully comply with the directions mentioned in the said Order dated 24.07.2025.
9. Accordingly, the Anticipatory Bail Application stands disposed of. JUDGE Comparing Assistant
