4. Petitioner was granted licence for running fair price shop in Village Seedhru, Laksar, District Haridwar. His licence was suspended by District Magistrate, vide order dated 27.09.2024. Petitioner filed appeal against the said
order, which was allowed and the matter was remanded back to District Magistrate to pass order afresh, as per law.
5. Petitioner contends that District Magistrate, Haridwar has not passed any
order after remand, and now, Gram Panchayat has been
directed to recommend the name of some other person, who may be appointed as fair price shop dealer. This, according to petitioner, is unjust and unsustainable, as petitioner’s licence has not been cancelled as yet.

Learned State Counsel, however, submits that writ petition is premature, as merely by calling upon Gram Panchayat to pass a resolution for appointing some other fair price shop dealer, no prejudice is caused to petitioner. He submits that if petitioner has any grievance, then he can approach the Competent Authority by making a

7. This Court finds substance in the submission made by learned State Counsel. Since no one has been appointed as fair price shop dealer in place of the petitioner, therefore, merely because Gram Panchayat has been asked to pass a resolution for appointing new fair price shop dealer do not cause any legal injury to the petitioner, which may warrant interference of this Court.
8. The writ petition is, accordingly,
disposed of with liberty to petitioner to make representation to District Magistrate, highlighting his grievance. If petitioner makes representation within one week from today, District Magistrate, Haridwar shall look into the matter and take appropriate decision, as per law, within three weeks thereafter. For a period of four weeks or till decision is taken, whichever is earlier, no precipitative action shall be taken against the petitioner.
