Paliwal, learned counsel for the petitioner. 2. Mr. Manish Kumar, learned counsel holding brief of Mr. Ashish Joshi, learned counsel for the respondent/ corporation. 3. Petitioner was appointed as Driver in erstwhile State of Uttar Pradesh Transport Corporation and he retired from Uttarakhand Transport Corporation in the year 2021. 4. After his retirement, an order was passed against him on 16.12.2021 by Regional Manager (Operation), Uttarakhand Transport Corporation, Tanakpur whereby a sum of Rs. 95,486/ - was deducted from his gratuity. Thus feeling aggrieved, petitioner has approached this Court. 5. Learned counsel for petitioner submits that the issue involved in this writ petition has already been decided by coordinate Bench in WPSS No. 257 of 2025, and affirmed by Division Bench in Special Appeal No. 245 of 2022. He thus submits that present writ petition deserves to be decided in terms of aforesaid judgments. 6. Learned counsel appearing for Uttarakhand Transport Corporation concedes that the dispute involved in this writ petition stands decided by Division Bench in Special Appeal No. 245 of 2022. 7. In view of the consensus between the parties, writ petition is decided in terms of judgment rendered in WPSS No. 257 of 2025, as affirmed by Division Bench in Special Appeal No. 245 of 2022 ( Alok Mah r a, J.) 03.12.2025 BS
