This anticipatory bail application under Section 482 & 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 457 and 380 of the Indian Penal Code pending in the Court of JM 1st Class, Dhanbad in connection with Tundi PS Case No. 09 of 2024. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. From the shop several mobile phones were stolen. By tracing the IMEI one mobile phone was found to be in the possession of this petitioner. Admittedly police issued a notice under section 35(3) of the BNSS to the petitioner. The petitioner complied the said notice and appeared before the police and handed over the mobile phone to the police. This suggests that the petitioner is cooperating with the investigation. Further the police did not arrest the petitioner which also suggests that there is no apprehension of the petitioner being arrested. That being so, the petitioner should appear before the court concerned and file necessary bail bonds as I am of the opinion and also from the facts of this case, I do not find that there is any apprehension of the petitioner being arrested. The petitioner should cooperate with the investigating officer during investigation failing which the court concerned may take appropriate steps against the petitioner. 5. Accordingly, this Anticipatory Bail Application stands disposed of. (ANANDA SEN, J.) Nibha/-
