1. Heard. 2. This petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:-
“10.1 That, the Hon’ble Court may be pleased to
2 issue a writ of mandamus commanding the respondents. The present petitioner is still working as Guruji and in the meanwhile he has acquired the qualification of Higher Secondary pass. The Authority kind taken for considering the petitioner case of absorption on the post of Contract Teacher Grade-III which was later on reignited as Shiksha Karmi Grade-III. 10.2 That any other relief which this Hon’ble Court deems fit and proper under the facts and circumstances of the case may kindly be awarded in favour of the petitioner.”
3. Learned counsel for the petitioner would submit that petitioner is working as ‘Guruji’ in the Education Guarantee Centre (EGC) since 2003. The State Government has decided to upgrade EGC as Primary Schools, it was also decided that such ‘Gurujis’, who are having qualification as Contract Teacher Grade-III shall be absorbed and those who are not having qualification shall be granted time to acquire qualification of Higher Secondary within 2 years, till then, they shall be paid honorarium, as was paid to the ‘Gurujis’.
It was further submitted that subsequently, petitioner has also passed 12th Board examination of State Board, as such, he has also acquired necessary qualification for his absorption on the post of Contract Teacher, despite that, he has not been posted by the respondents No.4 & 5 on the post of Contract Teacher. He further submitted that petitioner is ready to file representation before respondents No.4 & 5 for redressal of his grievance and this petition may be disposed of directing respondents No.4 & 5 to consider and decide his representation within the period specified by this Court. 4. Counsel appearing for the State/respondents No.1 to 3 has no objection to allow the limited prayer of the petitioner. 5. I have heard learned counsel for the parties and perused the material available on record. 3

Having considered the aforesaid facts of the case and limited prayer of the petitioner, this petition stands disposed of, granting liberty to the petitioner to file representation before respondents No.4 & 5 for redressal of his grievance within a period of 15 days from today. Thereafter, respondents No.4 & 5/competent authority are directed to consider and decide the representation filed by the petitioner within a further period of 60 days from the date of filing of representation along with copy of this order. 7.
