Similarly, learned senior counsel for the respondents No. 4 & 5, Mr. HS Paonam; learned counsel for the respondents No. 3 & 6, Mr. Ch. Ngongo; learned counsel for the respondents No. 1 & 2, Mr. L. Raju are present before this Court physically. [2] This contempt proceeding is filed by the petitioners/complainants under the provision of Section 2(b) of the Contempt of Court’s Act, 1971 whereby seeking for taking action against the respondents/accused for willful disobedience of the Court’s order passed in PIL No. 74 of 2021 dated 26.05.2021. [3] The learned counsel for the complainants/petitioners is submitting that the order rendered by the Co-ordinate Bench in the aforesaid PIL has not been absolutely complied with and this submission made by the learned counsel for the complainants/petitioners is taken on record. This submission made by the aforesaid learned senior counsel is taken on record. [5] Learned senior counsel for the respondents No. 3 & 6, Mr. Ch. Ngongo is submitting that this contempt proceeding is initiated by the complainants/petitioners seeking for intervention of the order rendered by the Co-ordinate Bench in the proceeding of PIL No. 74 of 2021. However, the order has been rendered on 26.05.2022, and the same has already been complied with. This submission which is made by the aforesaid learned senior counsel is taken on record. [6] Learned counsel for the respondents No. 1 & 2, Mr. L. Raju is submitting that the order rendered by the Ld. Co-ordinate Bench in the aforesaid PIL proceeding dated 26.05.2022 has already been complied with to the effect that report has also been submitted for consideration. [7] This contempt petition proceeding has been initiated by the complainants/petitioners for seeking intervention of the Court’s order rendered by the Co-ordinate Bench in PIL No. 74 of 2021 dated 26.05.2022. However, the present proceeding has been initiated based on the notification dated 20.06.2022 vide No. 01/2021/SE-PDA/115 issued by the Secretary, Planning & Development Authority, Manipur and the same has been indicated in the material available on record. However, there has been indicating that some order has been passed by the Co-ordinate Bench in PIL and the order dated 26.05.2022 has already been complied with by the respective respondents arranged in this contempt proceeding. [8] P a g e 3 | 3 [8] However, the contempt proceeding has been initiated keeping in view of the provision of Section 2(b) of Contempt of Court’s Act, 1971 and inclusive of Article 215 of the Constitution of India. [9] But, the learned counsel for the respondents/accused in this matter is submitting that the order rendered by the Co-ordinate Bench in PIL No. 74 of 2021 has already been complied with and therefore, it does not arise to proceed further to take action against the respondent/accused.
