Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application under section 483 Cr.P.C. has been filed with the prayer to direct the learned Judicial Magistrate-II, Gonda to decide the proceedings of Criminal Misc. Case No. 460 of 2007; State of U.P. Vs. Nanke and others, arising out of Case Crime No. 252 of 2006, under Sections 325, 323, 504, 506 IPC, Police Station Mankapur, District Gonda, expeditiously. Learned counsel appearing for the applicant submits that the matter pertains to the year 2007, but even after passing of seventeen years, the proceeding of the case has not been concluded as yet. After arguing at length, learned counsel appearing for the applicant submits that interest of justice would be sub-surved if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the learned Judicial Magistrate-II, Gonda is directed to decide the proceedings of Criminal Misc. Case No. 460 of 2007; State of U.P. Vs. Nanke and others, arising out of Case Crime No. 252 of 2006, under Sections 325, 323, 504, 506 IPC, Police Station Mankapur, District Gonda, with Versus Counsel for Applicant(s) : Pankaj Kumar Singh Counsel for Opposite Party(s) : G.A.
