On 07-04-2025 when specific query was made from the learned counsel for the petitioner whether any proceeding was drawn by the Sub-Divisional Magistrate after 05-09-2024, he submitted that no order sheets have been drawn by the Sub-Divisional Magistrate. Therefore, this Court has called a report from the Sub-Divisional Magistrate, Podi Uproda with respect to the order sheets of the case. 2. Today, learned counsel for the State has submitted copies of the order sheets and other relevant documents of the case pending before the Sub- Divisional Magistrate, Podi Uproda which has been taken on record. From Digitally signed by MOHAMMAD AADIL KHAN 2 perusal of the order sheet, it transpires that the order sheet upto 17-04- 2025 in the case is regularly drawing before the Sub-Divisional Magistrate, Podi Uproda. 3. Learned counsel for the petitioner would submit that he has filed the petition for a limited prayer that the proceeding before the Sub-Divisional Magistrate Podi Uproda, District Korba under Section 145 of the Cr.P.C. is pending since 14-08-2024 and till date it has not been concluded, therefore, a direction may be given to the concerned Sub-Divisional Magistrate to decide the case as early as possible within stipulated period. 4. The submission made by learned counsel for the petitioner has not been opposed by the learned counsel for the State and would submit that she is not having any objection if such direction is passed for early disposal of the case. 5. On due consideration and on the submission made by learned counsel for the parties, I deem it appropriate to direct the Sub-Divisional Magistrate Podi Uproda to expedite the proceeding of the case and conclude the same within a reasonable period. Therefore, the Sub-Divisional Magistrate Podi Uproda, District Korba (C.G.) is directed to expedite the proceeding of Criminal Case No.202408050300006/ Section - 145/2023-24 pending before it as early as possible and conclude the proceeding and decide the case within three months from the date of production of certified copy of this order after giving opportunity of hearing to the concerned parties in accordance with law. 6.
