Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material on record. Instant application has been filed with the prayer to direct the opposite party no.2 to decide the Protest Petition of the applicant in Case Crime No.0164 of 2023 under Sections 498A, 323, 376, 313, 308 I.P.C. & 3/4 D.P. Act, Police Station Mishrit, District Sitapur pending before the Additional Chief Judicial Magistrate-I, Sitapur which is pending since 4.5.2024 expeditiously within stipulated period. Learned counsel for the applicant submits that the matter relates to the year 2023. He further submits that the trial court may be directed to decide the Protest Petition of the applicant in the aforesaid case crime number within stipulated period of time as may be fixed by this Court. Learned A.G.A. for the State has no objection to the submissions aforesaid. In view of the aforesaid submissions and innocuous prayer made in the application, the trial court is hereby directed to decide the Protest Petition of the applicant in the aforesaid case crime number, i.e., Criminal Misc. Case No.0164 of 2023 with expedition, in accordance with law. With the aforesaid observations, instant application stands disposed of accordingly.
