Ms. A. Gayan, the learned CGC who represents the respondent No. 1 submitted that the respondent Nos. 1 and 2 have been unnecessarily impleaded in the present proceedings inasmuch as the non-payment, for which, the petitioner has approached this Court pertains to the State Disaster Response Fund which is under the Revenue and Disaster Management Department of the Government of Assam.
2. Taking into account the above, the learned counsel appearing on behalf of the petitioner submitted that the
Page No.# 3/3 Revenue and Disaster Management Department of the Government of Assam has not been impleaded in the instant writ petition. The learned counsel therefore submitted that the petitioner may be permitted to withdraw the instant writ petition with liberty to file a fresh one by impleading the necessary parties.
3. Accordingly, the instant writ petition stands closed on withdrawal with a liberty to the petitioner to file a fresh writ petition by impleading the necessary parties.
