3 The Court made the following order: The present Writ Petition is filed questioning the action of the respondents in not releasing the amounts of Rs.8,73,992/- and Rs.7,58,869/- to the petitioner despite completion of execution of work of 1.) O&M - Weed removal, left bank of Bheemanadhi channel at km 8.20 in Movva Mandal, Krishna District; and 2.) for removal of weed growth on Bheemanadhi channel in between km 11.00 to km 22.40 including its branches v/deAgt.Nos. 16/2023-24 & 17/2023-24, dated 16.06.2023. 2. It is the case of the petitioner that the respondents have floated tender for execution of the said work in which the petitioner became the lowest bidder. It is the further case of the petitioner that he entered into agreement dated 16.06.2023 with respondent No.5. Thereafter, he has completed the said work within the stipulated time as per the agreement. It is further case of the petitioner that the Engineers in the Irrigation Department have inspected the works executed by the petitioner and, thereafter, the same were super-checked by the Quality Control Team. The concerned authority after full satisfaction, forwarded the records i.e., agreements, M-book, bill forms etc. to the
4 Accounts Department, so as to pay the same to the petitioner. It is further case of the petitioner that despite completion of works and coupled with the fact that Quality Control Certificate was issued, for the reasons best known to the respondents, the said amount has not been released till today. Questioning the same the present writ petition is filed. 3.
On the other hand, the learned Government Pleader for Irrigation placed on record the written instructions dated 26.07.2025, furnished by the 5*^ respondent. On perusal of the same, it is clear that the petitioner has completed the works entrusted to him in accordance with the conditions of the th agreement entered into and it is further stated that, the 5 respondent is taking steps to get approval for payment of the amount due to the petitioner. The said instructions dated 26.07.2025, is placed on record. 4. Accordingly, the writ petition is allowed, directing the respondents to release the amount payable to the petitioner in respect of works completed by the petitioner under the subject agreements, within a period of eight (08) weeks from the date of receipt of a copy of this order.
