1. The present anticipatory bail application has been filed seeking anticipatory bail in FIR No.-508/2025, U/S-108 BNS, Police Station.- Kotwali City, District- Hardoi.
2. Heard learned counsel for the applicant as well as learned AGA for the State.
3. Notice to respondent no. 2 is dispensed with in view of the proposed order.
4. Learned counsel for the applicant submits that the applicant, being a lady, is innocent and has been falsely implicated in the present case. It is contended that the essential ingredients of Section 108 BNS are absent. As per the prosecution's own case, the victim had been residing separately from the applicant for more than two months.
5. On the other hand, learned AGA has opposed the bail application, contending that the applicant was involved in an extramarital relationship with one Harshit Soni, which ignited frequent quarrels between the deceased and the applicant. It is further alleged that the applicant assaulted and threatened her husband, due to which committed suicide. A seven-second video of the suicide, recorded by the deceased's brother, has Versus Counsel for Applicant(s) : Amol Kumar Srivastava, Apoorv Srivastava, Shivang Dwivedi Counsel for Opposite Party(s) : G.A. Mansi Kashyap .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Home Lko. And Another .....Opposite Party(s)
also been placed on record. It is submitted that this is not a case of false implication, nor can it be said that the applicant has been implicated merely to tarnish her reputation.
6. Perused the record.
7. Upon perusal of the record, it appears that the cause of death is antemortem hanging. The offences alleged are of a serious nature, and there is corroborative evidence supporting the prosecution's case. It cannot be said to be a case of false implication. I am not inclined to exercise the extraordinary jurisdiction of this Court, and accordingly, the anticipatory bail application stands dismissed. September 3, 2025 R.C.
