Heard learned counsel for the petitioner and learned Standing counsel for the State Respondent no. 1 and Shri K.K. Pandey, learned counsel for the respondent nos.2 and 3. 2. This petition has been filed with the following main prayer:- "Issue a writ order or direction in the nature of Mandamus commanding the opposite parties concerned to construct a proper road from Hafiz Dada ki Masjid to Body Care and Cure Clinic in Ujariyaon, Gomti Nagar measuring about 220 metres approximately within a specified time frame expeditiously as early as possible in the interest of justice." 3. In pursuance of the order passed by this Court on 03.09.2025, Shri K.K. Pandey, has appeared on behalf of Nagar Nigam and he has placed before this Court a report signed by the Assistant Engineer, Junior Engineer, Zonal Officer, Tax Officer and Executive Officer of Nagar Nigam Zone-4 wherein it has been stated that the petitioner has been paying house tax as assessed by the Nagar Nigam and the road in question from Hafiz Dada ki Masjid to Royal Zaika Hotel along with drain on both sides has been proposed to be repaired/re-metalled and an estimate of Rs.31,32,000/- were made ready but because of limited financial resources of Nagar Nigam, the work could not be started. 4. This writ petition is disposed of with a direction to the respondent No.2 to ensure that the road construction as proposed by the Executive Engineer, Zone 4 shall be placed in the next development plan proposed by the Nagar Nigam and financial approval shall be sought from the appropriate authority and road construction as proposed be carried out after such financial sanction is made within a period of two weeks from the date of such financial sanction.
