1 criappln-1724-2024 IN THE JUDICATURE OF HIGH COURT AT BOMBAY BENCH AT AURANGABAD 34 CRIMINAL APPLICATION NO. 1724 OF 2024 GHANASHYAM DAMU WAGH VERSUS THE STATE OF MAHARASHTRA AND ANOTHER …. Advocate for Applicant : Mr. Suniket A. Kulkarni APP for Respondent No.1-State : Mr. G.A. Kulkarni Advocate for Respondent No.2 : Mr. Mukul S. Kulkarni ….
CORAM : SMT. VIBHA KANKANWADI & SANJAY A. DESHMUKH, JJ. Dated : 13th June 2025 PER COURT :-
1. By order dated 20th January 2025, we had directed the learned Advocate for the applicant to place the complete charge-sheet on record. The amendment has been carried out. But, as the complete charge-sheet has not been filed, those directions were given.
2. Learned Advocate for respondent No.2 and learned APP are pointing out that the present applicant is absconding and the charge-sheet is filed under Section 299 of the Code of Criminal Procedure (for short “the Cr.P.C.”) against him.
3. Sufficient time was granted to the applicant to place the proper charge-sheet on record. But, again, learned Advocate for the 2025:BHC-AUG:15019-DB
2 criappln-1724-2024 applicant submits that he has received the certified copy of the charge-sheet which is incomplete. We do not exercise our powers under Section 482 of the Cr.P.C. in favour of an accused, who is absconding. Under such circumstance, we dismiss the application at the threshold.
4. In view of the above, the application stands dismissed.
